Groundwater Availability Certification
Senate Bill 2440 took effect on January 1st, 2024, and the modified government code states “a plat application for the subdivision of a tract of land for which the water supply source is groundwater” – must have attached a statement by a licensed engineer or licensed geoscientist in the State of Texas that certifies adequate groundwater is available for a subdivision.
This legislation references the already established Chapter 230 in the Texas Administrative Code, which is titled “Groundwater Availability Certification for Platting”. These documents are the framework for completing groundwater studies and outline the neccessary requirements of a completed study.
The Upper Trinity Groundwater District has entered into an interlocal agreement with the following entities to review those studies on behalf of the platting authority. More information about the studies can be found through the summary documents below.
